A) INTERPRETATION
“we” “our” and “us” means Conservatories You Build Ltd
“you” “your” means the customer ordering the goods subject to these terms and conditions

B) YOUR CONTRACT

These terms apply to all goods supplied by us to you. We reserve the right to change these terms and conditions of sale without prior notice to you in relation to future sales.

No contract exists between us and you for the sake of any goods until we have received and accepted your order and payment and you have been provided with confirmation of your order to the postal or e mail address you provide.

The order you place is designed especially for you to meet your specific requirements.

C) DESCRIPTION AND SALE OF GOODS

Our goods are described in detail on our web site (www.conservatoriesyoubuild.co.uk) along with the products current price including VAT. For all further information or descriptions of any product please contact us.

We endeavor to ensure that our website carries our most up to date prices. In the unlikely event that a pricing error should occur we reserve the right to notify you as soon as possible and offer you the option to continue with your order at the correct price, alternatively you may cancel your order and a full refund of any payment already made will be provided within 30 days in the original form it was received.

D) PAYMENT

50% of the total cost of your conservatory is to be made to us prior to the order being processed. We accept all major credit cards (with the exception of American Express.) Cheques are to be made payable to Conservatories You Build Ltd and you must allow 5 days for cheques to clear before any order is processed.

Once we have a confirmed delivery date for you we will require the remaining 50% of the cost of the conservatory to be paid.

If you choose to pay for your product via Paypal the information you provide is subject to their terms and conditions of use.

E) DELIVERY

Delivery is free to certain areas of the United Kingdom, please contact us to check that you are in the catchments area for free delivery.

All delivery dates quoted are an approximate guide only.

We will endeavor to deliver your order on the agreed date and will inform you at the earliest possible time should there be any delay.

If your order is not delivered as arranged, we are not responsible for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

The delivery will be made to the address agreed between us and you. The delivery will be made to the nearest available point that the delivery vehicle is able to access at the agreed address.
If the delivery point is not accessible for the delivery vehicle it is your responsibility to accept the delivery at the nearest available point and transport the goods the remaining distance yourself.
You must supply a person to check off the goods delivered and supply sufficient labour to be able to unload the goods.

If we are unable to deliver to the agreed address due to know one being present then delivery will be re-arranged at a further agreed time. We reserve the right to charge for this second delivery.

Responsibility for the goods will pass to you once they have been delivered.
We cannot be held responsible for loss or damage once you have received your order.
If any goods are delivered damaged or defected or your order has been delivered incorrectly you must notify us within 3 days.

F) LIABILITY

Any goods that have been installed cannot be returned unless they are faulty.
If you inform us of a problem regarding the above clause we will either:

1) Make good any shortage or non-delivery
2) Replace or repair any goods that are damaged or defective.

Our products are supplied to you for self installation and it is your responsibility to ensure that they are installed correctly.

We can offer guidance to you for the installation but we cannot be held responsible for any loss or damage arising from information we have provided regarding the installation of your product.

We are not responsible for indirect or consequential loss, damage or expense arising out of any problem you notify to us.

We shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the specific parts in question as in clause J2.

G) CHANGES TO ORDER
All conservatories are made to order and the order is processed once your signed order form is returned to us and at least 50% of the total cost is received. If you require any changes to be made to your order there may be an additional charge for any components that have or are in the process of being manufactured and cannot be used elsewhere in your order.

H) WARRANTY
The warranty is non transferable and provided on the basis that’s the goods have been installed correctly and in accordance with guidelines provided. The warranty does not affect your statutory rights as a customer.

Defects arising from wear and tear, willful damage, accident, negligence, faulty installation by you or a third party or any alteration or repair carried out by a third party are not covered by this warranty.

Should any goods supplied by us to you develop defaults under warranty you should notify us in writing as soon as possible.

Should we replace an item under warranty we reserve the right to arrange (at our cost) for the original item to be returned to us.

I) DATA PROTECTION
We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we will not be liable for unauthorized access to information supplied by you.

We agree to use the information provided by yourself for the purpose of fulfilling your order and will not sell or give your details to third parties for marketing purposes.

J) EVENTS BEYOND OUR CONTROL
We shall have no liability to you for any failure to deliver goods that you have ordered or any delay in doing so or for any damage or defect to goods that is caused by any event or circumstance beyond our control including without limitation, strikes, lock out, and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

K) INVALIDITY
If any of these terms and conditions is unenforceable then the enforceability of other parts of these terms and conditions will not be affected.

L) ENTIRE AGREEMENT
These terms and conditions together with our current website prices, specifications, delivery details and contact details set out the whole agreement relating to the supply of the goods to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions or as unauthorized representation about the nature of or quality of any goods offered for sale by us.

M) THIRD PARTY RIGHTS
Except for our directors, employees or representatives, a person who is not party to this agreement has no right under the contracts (rights of third parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third arty that exists or is available apart from that Act.

M) COOLING OFF PERIOD
Orders are not placed until signed ORDER FORM is retured to Conservatories You Build. From placement of order customer has 14 days to cancel order and receive a full refund of monies paid. However if conservatory is delivered and fitted by the customer or third party within this period NO refund can be given.
